1. Definitions & Contract Formation
Marvel Treks is a leading travel company (5258/057-58) registered as Marvel Treks and Expedition under the Nepal Companies Act. Our company is located at Lekhnath Sadak, Thamel, Kathmandu, Nepal. We are very happy to be of service to you, our esteemed customer.
It is important that you understand the terms and conditions of this agreement. By agreeing to these terms, you are confirming your acceptance of our conditions and rules. If you do not agree with any part of these terms and conditions, please do not use our service or portal.
We will not tolerate any abuse of our system or portal. We reserve the right to suspend access immediately if we suspect that someone has been abusing our system or portal. We also reserve the right to terminate your account at any time without notice if we believe you have abused our system or portal in any way.
Additionally, we reserve the right to deny access for any reason at any time without notice if we believe that this action would be in the best interest of all parties involved.
The company reserves the right to change these terms and conditions at any time. It is your responsibility to check regularly to ensure that you are aware of any changes made by us.
2. Booking, Deposit & Payment
- A non-refundable deposit of 20% of the total trip cost is required at the time of booking unless otherwise stated.
- The remaining balance must be paid no later than the day before trip departure or upon arrival in Kathmandu (or as otherwise agreed).
- Accepted payment methods: bank transfer, major credit cards (Visa/MasterCard), Western Union or crypto (binance ),paypal,bank transfer in australia , USA, cashapp, revolut, zelle other means as specified in your booking form.
- All transaction fees and currency conversion costs are the client’s responsibility.
- If payment is made by credit card in nepal in office , a surcharge (e.g., 3.5 %) may apply to cover processing fees.
3. Cancellation by Client
- Cancellations must be submitted in writing (email) and acknowledged by the Company.
- Cancellation charges (percentage of total trip cost) apply as follows (example schedule – adjust as needed):
- 40+ days before departure: loss of deposit only. (online transfer)
- 15-39 days before departure: 40% of total cost. (online transfer)
- Less than 7 days (or no-show): 60% of total cost or full cost depending on itinerary. (can be done in office after arrival if you send your passport coppy transfer)
- 40+ days before departure: loss of deposit only. (online transfer)
- No refund for unused services once the trip has begun and you choose to leave early.( apply to Expedition and kailash only)
4. Cancellation or Alteration by Company
- The Company reserves the right to cancel your trip prior to departure due to circumstances beyond our control (e.g., natural disasters, political unrest, flight delays, weather). In this case we will offer either:
- A full refund of trip cost, or
- An alternative trip of equivalent value.
- A full refund of trip cost, or
- If significant itinerary changes are required, you may accept the change, take an alternative trip or request a refund of the trip cost. We are not liable for incidental expenses such as non-refundable flights, parking, visas, lost earnings or other consequential losses.
5. Medical Conditions, Fitness & Special Requests
- You must notify us in writing of any medical, physical or mental condition that may affect your ability to participate in the trip. Failure to do so may result in exclusion from the tour without refund.
- Some treks are unsuitable for persons with limited mobility, pregnant travellers, or other special conditions – you must check suitability before booking.
- We will do our best to accommodate dietary or other special requests, but these do not form part of the contract unless explicitly agreed in writing.
- If you require last-minute arrangements (e.g., helicopter, alternate transport) you will cover any additional cost.
6. Amendments by Client
- Amendment requests (change of itinerary, name change, extra services) received 21 days or more before departure: may be made with a fee (e.g., US$50 per person).
- Amendments within 21 days of departure may incur higher fees depending on the cost incurred by the Company.
7. Insurance, Rescue & Evacuation
- Comprehensive travel insurance is mandatory for all clients. It must cover at minimum: medical treatment, emergency evacuation (including helicopter rescue to appropriate altitude for your trek), trip cancellation and lost baggage.
- A copy of your insurance policy must be provided before the trip begins.
- The Company is not responsible for costs incurred due to inadequate or missing insurance.
8. Risk, Responsibility & Liability
- Adventure travel involves significant risks: remote terrain, high altitude, unpredictable weather, landslides, flight delays, illness, and other hazards.
- You accept these risks and agree the Company and its agents are not liable for death, bodily injury, loss of personal belongings, delays, trip interruptions or additional costs arising from factors beyond our control.
- Your personal gear and belongings remain your responsibility.
9. Itinerary, Accommodation, Transport & Changes
- Itineraries are given as guidelines and may be changed due to safety, weather, government regulations, porter/guides availability or other factors.
- Accommodation, transportation and other services may be changed to equivalent standard without prior notice.
- Flights, mountain permits and other arrangements may be subject to weather or regulatory delays – you must remain flexible and carry extra funds for unexpected waits.
10. Passport, Visas, Permits & Foreign Legislation
- You must ensure that your passport, visa, trekking permit, and any other documentation are valid.
- The Company is not accountable for delays, extra nights, inability to enter or remain in Nepal due to incomplete or invalid documentation.
- Any costs arising from missed connections, lost flights or additional nights due to official requirements are your responsibility.
11. Personal Conduct & Removal
- If your behaviour is considered anti-social, dangerous, negligent or causes disruption to the group or local environment, the Company or guide may exclude you from the trip.
- In such case no refund will be issued and you are responsible for your return journey and any additional costs.
12. Force Majeure & Unforeseen Events
- The Company cannot be held liable for delays, injury, loss, death or additional costs caused by: war, terrorism, political action, natural hazards, weather, fire, labour strikes, airline cancellations, government intervention or any other event outside our control.
- In such events we will attempt to provide alternatives, but you accept that refunds may be limited to the net cost of unused services.
13. Price Changes & Currency Fluctuations
- Trip prices are based on current quote and may increase if there is a large change in currency exchange rates, fuel cost, permit fees or government taxes.
- If you re-book at a higher rate you must pay the difference.
14. Governing Law & Disputes
- These Terms and Conditions are governed by the laws of Nepal.
- Any dispute shall be referred to the competent court in Kathmandu, Nepal (or as agreed).
15. Intellectual Property & Website Content
- All text, images, itineraries on our website are the property of the Company and may not be reproduced without permission.
- We endeavour to maintain current information but we do not guarantee accuracy of external links or partner services.
16. Acceptance of Terms
By making a booking with us you confirm you have read, understood and accepted these Terms & Conditions.
